These Terms and Conditions ("Terms") govern your use of the Kimberley Astronomy Tours ("KAT", "we", "us", "our") website and the purchase of our tour experiences and related services. Kimberley Astronomy Tours operates under ABN 96 684 464 426. By accessing our website or making a booking, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
KAT provides guided astronomy tour experiences at Eighty Mile Beach Caravan Park, Western Australia. Our services include:
Tours are available exclusively to guests of Eighty Mile Beach Caravan Park. Tour availability is subject to weather conditions and lunar phases.
Booking confirmation: A booking is confirmed once full payment has been received and you have received a booking confirmation email. Until payment is processed, your booking is a reservation only and may be released.
Payment: All prices are in Australian Dollars (AUD) and include GST where applicable. Payments are processed securely through Square. We accept major credit and debit cards.
Pricing: We reserve the right to change our pricing at any time. Price changes will not affect bookings that have already been confirmed and paid.
Accuracy: You are responsible for ensuring that all booking details (name, email, phone number, number of guests) are accurate at the time of booking.
We understand plans can change. Our cancellation policy is as follows:
Australian Consumer Law: Nothing in this cancellation policy excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). If a service is not provided with due care and skill, or is not fit for a particular purpose, you may be entitled to a remedy regardless of this policy.
Refunds will be processed to the original payment method. Please allow 5-10 business days for the refund to appear on your statement.
Age: Children of all ages are welcome. However, children under 10 may not grasp all concepts presented during the tour. Children under 16 must be accompanied by a responsible adult.
Accessibility: The tour site is wheelchair and mobility accessible for the presentation and deep-sky astrophotography components. Due to the design of visual telescopes and the direction of celestial targets, some viewing may be difficult for guests with mobility limitations. Please contact Bob prior to your tour to discuss accommodation options — every effort will be made to ensure an enjoyable experience.
Behaviour: We reserve the right to remove any guest whose behaviour is disruptive, unsafe, or interferes with the enjoyment of other guests. No refund will be provided in such circumstances.
Alcohol: Guests are welcome to bring their own refreshments. VIP guests receive complimentary beverages. Please consume alcohol responsibly.
Smart telescope hire is subject to a separate Equipment Hire Agreement which must be signed before collection of equipment. The Equipment Hire Agreement governs the terms of hire, security deposit, damage liability, and return conditions. Please refer to the Equipment Hire Agreement for full details.
To the maximum extent permitted by law:
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian law, including liability under the Australian Consumer Law.
All content on this website — including text, images, graphics, logos, and software — is the property of Kimberley Astronomy Tours or its licensors and is protected by Australian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.
Gift vouchers are available for purchase. Gift vouchers are valid for 12 months from the date of purchase, are non-refundable, and cannot be exchanged for cash. Gift vouchers are subject to tour availability.
If you have a complaint or dispute regarding our services, please contact us first at [email protected]. We will endeavour to resolve the matter promptly and in good faith. If the dispute cannot be resolved within 14 days, either party may refer the matter to the relevant small claims tribunal in Western Australia (Magistrates Court of Western Australia, Minor Cases Division).
These Terms are governed by and construed in accordance with the laws of Western Australia. The parties submit to the non-exclusive jurisdiction of the courts of Western Australia.
We may update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
